Privacy protection holds a central place in the values of LUX-ASSURANCES S.A. – Main agency FOYER established and headquartered at 49 bd Grande-Duchesse Charlotte, L-1331 Luxembourg, and registered with the Trade and Companies Register, Luxembourg section B 22.6128.

We are committed to protecting and processing your personal data in strict compliance with current regulations, in full transparency. This privacy statement aims to establish a climate of trust during your visit to our website www.lux-assurances.lu and when using our online services.

Who is affected by the processing of personal data ?

These individuals whose personal data is processed by LUX-ASSURANCES S.A. – Main agency FOYER include:

  • All individual clients, 

  • All other individual stakeholders involved in operational processes, whether as agents, partners, suppliers, administrators, employees, legal representatives, or any other guarantor or contact person.

 

This statement does not concern legal entities.

 

In the context of your interactions with LUX-ASSURANCES S.A. – Main agency FOYER, this declaration covers in particular:

  • Identification data such as name, first name, postal address, email address, telephone number, etc. 

  • Data necessary for the conclusion of any subscribed contract, such as the value of your real estate, your salary, etc. 

  • Data relating to personal characteristics such as age, gender, lifestyle, consumption habits, and leisure activities. 

  • Financial data 

  • Location data (GPS, route) in the context of specific insurance contracts. Driving data used for calculating a "scoring" affecting the insurance premium for a specific product.

In accordance with regulations, we only collect data of a particular category as defined in Article 9 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 concerning the protection of individuals with regard to the processing of personal data and on the free movement of such data, in the cases specifically provided for by the exceptions set out in the following points:

  • Point 2.a: when consented to by the data subject, 

  • Point 2.b: as part of contractual performance in social protection matters, 

  • Point 2.g: for the pursuit of a public interest.

 

Unless specifically provided by law or exceptions provided by law, this data includes health-related data, deemed necessary for the pre-contractual and contractual purposes of the data controllers, as well as for the compensation of bodily injury by the data controllers in the pursuit of a public interest.

What is the purpose of processing your personal data ?

We undertake to process only data strictly necessary to achieve the objective aimed at by the processing, respecting the principle of data minimization and proportionality.

More generally, we use your personal data for :

  • In the context of pre-contractual stages with LUX-ASSURANCES S.A. – Main agency FOYER, 

  • In the context of contractual obligations, management of insurance contracts and claims, In accordance with current legal and regulatory provisions, 

  • For treatments to which you have explicitly consented, 

  • For treatments necessary to preserve legitimate interests such as fraud prevention and detection, 

  • Management of our customer service, 

  • Management of commercial relationships, 

  • Dispute resolution and debt collection,

  • On the one hand, we rely on the legitimate interests of the data controllers to inform you about products or services similar or complementary to those for which a commercial relationship exists, as well as for any non-commercial information (for example: risk prevention related to the contractual relationship).   • On the other hand, we rely on your consent to send you personalized offers and information and/or to inform you about innovations, tax benefits, and insurance news. You can withdraw your consent for direct marketing at any time, according to the procedures provided for in Article 9 concerning the exercise of your rights.

Sharing of personal data with LUX-ASSURANCES S.A. – Main agency FOYER

LUX-ASSURANCES S.A. – Main agency FOYER shares personal data with its network of agencies and subcontractors, respecting the provisions of professional secrecy as defined in Article 300 of the law of 7 December 2015 on the insurance sector, as well as the obligations regarding the subcontracting of personal data set out in Article 28 of the GDPR.

Transfer of data to third parties

The agency may share your personal data with its service providers, suppliers, and intermediaries as part of the management of insurance contracts.

As an insurer, LUX-ASSURANCES S.A. – Main agency FOYER may, in certain circumstances, share certain personal data with other insurers, reinsurers, insurance or reinsurance brokers, as well as with other intermediaries and agents, lawyers, technical experts/advisors, repairers, medical advisors, auditors, IT service providers, business partners, government authorities, and mediation bodies, whether located in the Grand Duchy of Luxembourg or abroad.

Our data may also be transmitted to public, regulatory authorities or courts.

Your data may be stored on cloud servers managed by a third-party host as part of specific products, in accordance with the provisions contained in the general or specific conditions of the products concerned. You are informed of this transfer when subscribing to the product for which you have accepted the conditions.

The transmission of data for commercial purposes is conditioned on your prior consent.

The agency may transfer your personal data outside the European Union, provided that, before any transfer, it verifies that entities located outside the European Union guarantee an adequate level of protection, in accordance with European legislation.

The agency may also be required to transfer your personal data to third parties if it is considered necessary for technical reasons (for example, for hosting services by a third party and the execution of the contract) or to protect its legal interests. Additionally, LUX-ASSURANCES S.A. – Main agency FOYER may disclose your personal data if required by law or if it is reasonably and in good faith believed that such disclosure is necessary to comply with legal process (for example, a warrant, subpoena, or other judicial order) or to protect the rights, property, or personal safety of the agency, our clients, or the public.

LUX-ASSURANCES S.A. – Main agency FOYER implements all necessary technical and organizational measures to ensure a level of security adapted to the risk identified by the processing concerned.

Retention period

Your personal data is kept:

  • For the duration necessary to achieve the purpose for which the data was collected or subsequently processed. 

  • To the extent required to comply with applicable legal obligations. While respecting legal limitation periods.

 

Right of access, rectification, erasure, objection, limitation, and portability

As a data subject, you have the right to access your data, as well as to receive information about the purpose of the processing for which your data is collected, the categories of data concerned, the recipients of your data, and the duration of their retention.

You have the right to data portability, which means that you have the right to receive your personal data in a structured format (from May 25, 2018, according to the defined conditions).

PROCEDURE TO FILE A COMPLAINT

You have the right to access, modify, rectify, delete, limit, and transfer your personal data, as well as to object, within legal limits, to the processing of your personal data.
